Visitation

Visitation rights are awarded to the parent who does not have physical custody of the child.  Visitation rights grant the other parent exclusive time to spend with the children.  It is advisable to have a set visitation regiment to accommodate the schedules of both parents.  This also gives each parent hard and fast rules regarding time spent with the children.  In the legal sense, visitation rights differ from physical custody in that visitation does not include any responsibilities or rights in decision-making.  Extreme situations, such as emergencies during visitation, are the exception to the rule; however, deference needs to be made to the parent who has physical custody.
